General Conditions

(in accordance with Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 and subsequent amendments and integrations).

1. Premessa ed efficacia delle Condizioni Generali

These General Terms and Conditions of Sale (hereinafter, “General Terms and Conditions”) govern the purchase of products and services made remotely and made available through the website https://en.stringproject.com (hereinafter, the “Website”) in accordance with Italian legislation, specifically Legislative Decree 206/2005 and subsequent amendments and integrations (hereinafter, the “Consumer Code”).

The seller of the products and owner of the Website is Vige s.r.l. with registered office at c.da Galdo, 46 84045 Altavilla Silentina (SA), VAT number and registration number in the Salerno Companies Register no. 05594850652, REA: SA – 458346 – Email address: [email protected] (hereinafter “Vige”).

The consumer who accesses the Website to make purchases (hereinafter “Customer”) is required, before submitting the order, to carefully read these General Conditions, which have been made available to them on the Website and can be consulted at any time by the Customer, including through the link contained in the order confirmation email, in order to allow them to reproduce and store them.

In the event that the individual making purchases on the Website requests the issuance of an invoice and/or is not a “consumer” as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the provisions regarding withdrawal set out in Articles 7 and 8 of these General Conditions, and more generally, the provisions that, in accordance with the same Consumer Code, apply solely to “consumers,” will not apply.

Contracts concluded with Vige through the Website are governed by these General Conditions in accordance with Italian law. The language available for concluding the contract is Italian.

2. Choosing and Ordering Products

The features and price of the various products for sale on the Website (hereinafter “Product” or “Products”) are indicated on the page dedicated to each specific Product.

To purchase the Products, the Customer must fill out and submit the electronic order form, following the instructions provided on the Website. The Customer must add the Product to the “Cart” and, after reviewing the General Conditions and Privacy Policy and confirming their acceptance, enter the shipping and billing information, select the desired payment method, and confirm the order.

By submitting the order through the Website, which constitutes a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase process and fully accepts these General Conditions and the specified payment terms.

The contract between Vige and the Customer shall be deemed concluded upon acceptance of the order by Vige. This acceptance will be communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing details, a list of the ordered Products with their essential characteristics, and the total price including delivery charges. The Customer shall review the confirmation email and, in the event of any errors in the order, shall have 12 hours from the receipt of such email to contact Customer Service directly from the Website using the dedicated contact form accessible through the “Contacts” tab. After this period, the order will be processed for shipping, and no further changes will be accepted, without prejudice to the Customer’s rights as specified in the subsequent Article 7.

Upon receipt of the order, Vige will verify the availability of stock for processing the order. If one or more Products are not available, Vige’s Customer Service will promptly send an email communication to the Customer, who will have the option, within the next 12 hours, to respond and confirm the shipment of any additional available Products or to cancel it. In the event of no response within this period, the order will be deemed confirmed, and the available Products will be shipped.

If only a few Products are out of stock, Vige will process the order with the available Products. In both cases, the amount corresponding to the missing Products will be refunded immediately, depending on the chosen payment method.

3. Product Information

The information and features related to the products, along with their respective product codes, are available on the website. The visual representation of the products on the website, where available, generally corresponds to the accompanying photographic image on the product page. Please note that the product image is for illustrative purposes and may not perfectly represent its features and quality. There may be differences in color and dimensions. In case of any discrepancy between the image and the written product description, the description on the product page always prevails.

4. Prices and Shipping

The prices of the products are inclusive of all taxes and fees. All prices are stated in Euro.

  • Shipping to Italy:

Throughout Italy, shipping is free for orders starting from 50 €. For amounts below that, the shipping cost is 6.90 €.

  • Shipping to international destinations:

The cost of shipping to international destinations is 12.90 €.

5. Payment and Invoicing

5.1 Payment Methods

The customer can make the payment for the price of the products and the related delivery charges by credit card, PayPal, bank transfer, prepaid cards, and cash on delivery.

  • Credit Card

The payment methods available on the website are as follows:

  1. Visa / Visa Electron
  2. Mastercard
  3. American Express

To ensure maximum security, the Customer will make the payment transaction directly on the bank’s secure server.

The Website does not store the Customer’s credit card number, but thanks to the secure communication system of the reference credit institution, for subsequent purchases, the Customer who wishes to do so – by selecting the appropriate option – can proceed with the purchase without re-entering their data. The reference credit institution uses the SSL protocol to encrypt the data transmitted between its server and the Customer’s browser.

  • PayPal

Una volta confermato l’ordine, il Cliente sarà reindirizzato al sito di PayPal dove potrà effettuare il pagamento con il suo conto oppure utilizzando una carta, anche prepagata, o comunque secondo le modalità accettate da Paypal e nel rispetto delle relative condizioni.

  • Bonifico bancario

Once the order is confirmed, the Customer will be redirected to the PayPal website where they can make the payment using their PayPal account or by using a card, including prepaid cards, or any other payment method accepted by PayPal and in compliance with their respective terms and conditions.

Reason for Payment: The Customer must indicate the date and order number in the payment reference of the bank transfer, which can be found in the confirmation email (e.g., “Order 01/01/17 no. 345”).

  • Cash on Delivery

This payment method is available only for shipments made within Italy and for orders with a total amount not exceeding €250. Payment will be made upon receiving the products and can only be done in cash. For cash on delivery shipments, the Customer is required to pay a shipping fee of €4.50.

5.2 Order Invoicing

If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate checkbox during the ordering process and entering the billing information, including the tax code and/or VAT number. In this case, the invoice will be sent via email to the provided address. The professional is responsible for ensuring the accuracy of the billing information and is explicitly informed that if the invoice is not requested during the ordering process, it cannot be requested later.

6. Transport and Delivery

The products purchased on the website will be delivered to the address provided by the customer during the purchase process in the designated “Shipping Address” field.

All purchases will be delivered by express courier (hereinafter referred to as “Courier”) from Monday to Friday, excluding holidays and national holidays. Vige is not responsible for unforeseeable delays or delays that are not attributable to it.

Once the Products are shipped, the Customer will receive a confirmation email that will include a link for tracking the shipment.

In any case, unless in cases of force majeure or unforeseen circumstances, the ordered Products will be delivered within a period of 7 (seven) working days starting from the day following the one in which Vige confirmed the order to the Customer through a specific order confirmation email.

7. Right of Withdrawal

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, subject to the exclusions provided for in the subsequent point IV. To exercise this right, the Customer must send a communication to Vige within 14 days from the date of receipt of the Products. If the Customer intends to exercise the right of withdrawal before receiving the Products, the withdrawal notice can be sent at any time prior to their receipt.

Once the communication is received, Vige’s Customer Service will open a case for the management of the return and will provide the Customer with instructions on how to return the Products.

The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the withdrawal only on a part of the purchased Product.

II. In the event of exercising the right of withdrawal, Vige will refund the customer the full amount of the returned goods, excluding shipping costs if applicable, within 14 days from the date the withdrawal notification is received, while reserving the right for Vige to withhold the refund until the goods are actually received. The refund will be made using the same payment method used by the Customer, unless the Customer has expressly requested a different method. In the case of a bank transfer or cash on delivery payment, it is the Customer’s responsibility to provide the bank details for the refund (account holder, name and address of the Bank, and IBAN).

III. In order to ensure the free return as provided for in the following Article 8, the Products must be returned in the same box in which they were received.

IV. In addition to the cases indicated in the Introduction (non-consumer customer and/or customer requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:

– order of customised or clearly customised products;

– order of products that are liable to deteriorate or expire rapidly;

– order of sealed Products that are not suitable for return for hygienic or health protection reasons or that have been opened after delivery.

8. Errors and limitations of liability

The information regarding the Products provided through the Website is constantly updated.

However, it is not possible to guarantee the complete absence of errors, for which Vige cannot be held responsible, except in cases of willful misconduct or gross negligence.

Vige reserves the right to correct errors, inaccuracies, or omissions, even after an order has been submitted, or to modify or update the information at any time without prior notice, without prejudice to the rights of the Customer under these General Conditions and the Consumer Code.

Except in cases of willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or partial fulfillment of an order.

9. Complaints

Any claims should be forwarded to Vige using the appropriate contact form accessible directly on the website through the “Contact” tab, or by registered mail with return receipt to the following address:

Vige undertakes to respond to all requests within a maximum of 7 working days.

10. Applicable Law and Jurisdiction

The sales contract between the Customer and Vige is deemed to be concluded in Italy and governed by Italian law. For the resolution of disputes relating to the interpretation, execution, or termination of these General Conditions or individual purchase orders, if the Customer is a consumer as defined by the Consumer Code, the competent court will be the one in their municipality of residence or domicile if located in Italian territory. In all other cases, the exclusive territorial jurisdiction is that of the Court of Salerno, and any other competent court is excluded.

According to Article 1341 of the Italian Civil Code, the Customer declares to have read and specifically accepts the following articles of these General Conditions: Article 6 (responsibility for delivery delays) and Article 8 (right to correct errors – exclusion of liability).
